By using theheliconia.com or any service offered by The Heliconia, you confirm that you have read, understood, and agree to abide by these Terms and our Privacy Policy. If you disagree with any part of these Terms, please discontinue use of our website and services.

These Terms apply to all visitors, prospective buyers, owners, tenants, and guests interacting with The Heliconia Residences and its associated entities.

About Us

The Heliconia Residences is a luxury residential project located in Vagator (Anjuna), North Goa, developed by Limovia Ventures Private Limited, a company incorporated under the laws of India.

All cheques and bank drafts for property bookings must be issued in favour of "LIMOVIA VENTURES PRIVATE LIMITED."

Use of Website

You agree to use our website lawfully and respectfully. You shall not:

• Use the website in any manner that could damage, disable, or impair its functioning
• Attempt to gain unauthorised access to any part of the website, server, or database
• Use automated systems, bots, or scrapers to extract data from our website
• Submit false, misleading, or fraudulent information through our enquiry forms
• Upload or transmit viruses, malware, or any harmful code
• Use our content for commercial purposes without prior written consent

Property Information & Disclaimers

All renderings, floor plans, dimensions, specifications, prices, and other property details displayed on this website or in our marketing materials are for general information purposes only. While we strive to keep this information accurate and up to date, the following points apply:

• Images, 3D renders, and visualisations are artistic representations and may differ from the final delivered product
• Furniture, fittings, soft furnishings, and accessories shown may not be part of the standard offering and are subject to inclusion as per the final agreement
• Prices, payment plans, and inventory are subject to change without prior notice
• Final sale terms, specifications, and possession timelines will be governed by the Agreement for Sale executed between you and Limovia Ventures Pvt Ltd
• Any projections regarding rental yield, capital appreciation, or returns are indicative estimates and do not constitute a guarantee

Bookings & Payments

Property bookings at The Heliconia Residences follow a structured process:

Booking Process

• An initial booking amount is required to reserve a unit (typically 10% of the agreed sale value)
• KYC documentation including PAN, Aadhaar, address proof, and applicable identification must be submitted
• The Agreement for Sale is executed within the timeline communicated at the time of booking
• NRI buyers must comply with FEMA, RBI, and applicable foreign exchange regulations

Payment Plan

• Payments follow a Construction-Linked Payment Plan with milestones tied to the progress of construction
• Applicable taxes (GST, stamp duty, registration charges) are payable in addition to the sale value, as per prevailing rates
• Maintenance deposits, club membership fees, and other one-time charges may apply as per the cost sheet
• All payments are to be made via bank transfer, RTGS, NEFT, cheque, or demand draft drawn in favour of "LIMOVIA VENTURES PRIVATE LIMITED"

Delays in Payment

Delayed payments beyond the due dates specified in the cost sheet or Agreement for Sale will attract interest as per the prevailing RERA-prescribed rate. Persistent default may result in cancellation of the booking, subject to forfeiture conditions detailed below.

Cancellation & Refund Policy

We understand that decisions can change. Our cancellation and refund terms are governed by the executed Agreement for Sale and are summarised below for transparency:

Cancellation by Buyer

• Cancellation requests must be submitted in writing to sales@theheliconia.com
• The booking amount may be subject to forfeiture as per the Agreement for Sale, which typically includes a cancellation charge to cover administrative, marketing, and opportunity costs
• Refunds, if applicable, will be processed within 60 working days from the date of acceptance of the cancellation, after deduction of applicable charges and taxes
• Refunds are processed only via the original mode of payment, to the same bank account from which payment was received

Cancellation by Developer

• The developer reserves the right to cancel a booking in case of persistent payment defaults, submission of false information, or breach of the Agreement for Sale
• In such cases, refunds will be processed in line with the cancellation clauses in the Agreement

Stay & Hospitality Bookings

For short-stay or hospitality bookings at The Heliconia, separate cancellation and refund terms apply, which are communicated at the time of booking. Generally, cancellations made more than 14 days prior to check-in are eligible for a full refund less processing fees, while cancellations within 14 days are subject to partial or no refund depending on the season and policy.

Intellectual Property

All content on this website — including but not limited to text, images, videos, logos, brand names, designs, floor plans, renderings, and architectural visualisations — is the exclusive property of Limovia Ventures Pvt Ltd, The Heliconia Group, and BuildHigh, or is licensed for our use.

You may not reproduce, distribute, modify, transmit, or use any of this content for commercial purposes without prior written permission from us. The trademarks "The Heliconia," "Heliconia Residences," and associated logos are protected and may not be used without authorisation.

User Submissions & Communications

By submitting an enquiry, testimonial, review, or any other content to us, you grant Limovia Ventures Pvt Ltd a non-exclusive, royalty-free licence to use, display, and reproduce such content for marketing and promotional purposes, with appropriate attribution where applicable.

You agree that any information submitted is truthful, lawful, and does not infringe upon the rights of any third party.

Our total liability for any claim arising in connection with these Terms shall not exceed the amount actually paid by you to us, if any, in the twelve months preceding the claim.

Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising in connection with these Terms or your use of our services shall be subject to the exclusive jurisdiction of the competent courts and/or RERA Authority of Goa.

Where applicable, disputes shall first be attempted to be resolved through amicable discussion or mediation before initiating formal legal proceedings.
